Are we entitled to post a picture when the owner refused it (which may be the case) ?

Are we entitled to post a picture when the owner refused it (which may be the case) ? It is not owner refusal. If the owner post the photo in Flickr and made public and allowed BBcode, he knows for sure it will be used. In our case, he removed the picture because he reposted with better resolution
