Smoking gun for a full blown criminal investigation? I hope it holds at least someone/people accountable. Not necessarily, in my opinion. I don't think this is new information, as the New York Times story already disclosed all this a few months ago (the paper apparently got wind of the information back in February or March). Furthermore, what they say in the text posted by Kevin is far from clear. So far, we have no information about the FBI investigation. I don't think these instant messages are enough for an indictment, let alone be tantamount to a smoking gun. As regards the FAA statement, I read it as rear-covering from the agency management. Didn't they read the NYT article when it was published ? One thing that is clear is he "lied" to regulator regardless what he lied about

Staggering revelations continue.
Meanwhile within a Comlux article ostensibly concerning Comlux and Airbus private frames, the boss of Comlux is quoted as follows: 'Outfitting on Comlux’s first of three Boeing BBJ Max 8s on order is around 75% complete, say Gaona. However, the aircraft will not be delivered at the end of the year as planned due to the grounding of the Max programme. “We cannot deliver the aircraft until we know what revisions need to be made to the aircraft,” says Gaona. “This may involve making changes to the cabin, and while the remaining features are ready to be installed, we have to wait. He describes the process as “frustrating”, but says Comlux is not ready to cancel the orders. “Our concern is that even when the Federal Aviation Administration approves the Max, and the aircraft gets back into service in the USA, other international aviation authorities will want to approve it separately, and that will take time,” says Gaona. “It will be the safest aircraft in the world.”'

Quite how such an outrageous claim as the last sentence can be made and the orator expect to be treated as a serious person is beyond me. On what objective basis would this be demonstrated by Mr Gaona of Comlux? What unsafe issues is he now aware of that he is convinced a change in B737Max oversight will overcome and reveal? Speak now or forever hold thy peace. These business leaders seem to be able to state anything that helps their interests, which in this case appears to be completion of three lucrative fit-outs of grounded Maxes.

somehow I can not imagine Mark Forkner taking the fifth over a misunderstanding, but that could of course be something else he was not talking about.
