The difference with other situations is that possibly the airline was fully entitled to cancel the order following 787 delays.

I wonder if Boeing would have already reassigned the delivery positions to other customers especially given the recent flurry of 787 orders. They can't have woken up to find out that Aeroflot was going to cancel the 787 only today. Obviously there would have been some deeper conversations going on especially with regards to penalties and refunds, and their intent would have been pretty clear.

So may be the idea is to order aircraft that you think might be late delivered or not up to the spec in the contract, then claim compensation and canx the order with no out lay of cash I could order a 100 Comacs, not pay a penny up front and then claim compensation ! Win win for me
